This chemical test failure  is defined as a person under 21 with a .02 blood alcohol   content or (BAC) or a person over 21gives a  sample of .08 or higher.   if you are  between the ages of 18-21 and you recieve a failed    breath test. &#8211; you will recieve 30 days loss of  license or until your case is terminated. plus an          additional 180 days under the junior operator law (JOL)  Going  into the JOL program might wave the 180 day suspension.    It is a similar alcohol education program that one would  receive in the “ 24D program”. Those    who are under 18 will incur the following penalty for failing  the breath test. 30 days or until termination of the case, plus          180 days under the JOL statue. The program they would have to  enter is similar to the “24D program”.<span id="more-54"></span></p>

The interlock device is required to be installed on your  car.</p>

			<content:encoded><![CDATA[<p>Melanie’s Bill has changed the face of Drunk Driving laws in Massachusetts. The changes implemented are:</p>
<p>Refusal to submit to a breath test or failure of that  breath test no longer issues a 15 day temporary license.  Chemical test refusals have been altered so that  there no eligibility for a hardship license. The refusal suspensions carry a punishment of: 180 days for a  first offense, 3 years for a second offense, 5 years for a  third offense. A lifetime for a forth offense.  <span id="more-57"></span></p>
<p>Hardship eligibility for second offense operating  under the influence, driving under the influence, OUI, DUI, DWI, takes one year for a work license and 18 months for a general  hardship license.  On a second or greater offense the requirement is  an installation of an ignition interlock device for  a minimum of two 2 years from the end date of the  conviction/suspension.  Concurrent Conviction suspension and refusal          suspensions have also been done away with. If your reading is above a .20 on a  chemical test and/ or you are a second offender then a alcohol/  drug evaluation will take place upon conviction. Anyone between the ages of 17-21 who submits  to a chemical test and the reading is above .20 must go to the  hospital for inpatient care in the 2nd offenders  program.  Evidence  introduced of prior convictions can be used as prima facie evidence of  prior offenses. Ignition interlock device needs to be installed  when the court says so   failure to comply with that rule could land you jail for 150  days. If you are operating while intoxicated or driving  drunk/oui, dui, dwi  with a suspended license  you could go to jail for a minimum of a one year term.  The crimes of knowingly allowing an unlicensed person to operate  your car, may carry a punishment of revocation of the registration  of the motor vehicle used in that crime for one year.  Drunk  driving on a forth conviction carries the potential of having  the vehicle used in that charge to be forfeited to the government.</p>
